The Supreme Court just ruled that Donald Trump can remain on Colorado's ballot, shutting down a decision from Colorado's Supreme Court that disqualified Donald Trump from the presidential ballot and determined that he incited an insurrection before and during January 6.1 Once again, we are witnessing the court side with MAGA extremism over democracy.

This ruling not only impacts Colorado but efforts across the country to disqualify Trump from the presidential ballot due to his violation of the 14th Amendment, which states that anyone who participates in insurrection is ineligible to run for office again.

And Justice Clarence Thomas—whose wife actively participated in the attempt to overturn the 2020 election2—ruled to keep Trump on the ballot. Despite calls to recuse himself from the case because of this major conflict of interest, he stayed on. And now look where we are.

Justice Thomas violated the Supreme Court's own code of conduct by ruling in this case, which states that a justice should not allow family, social, political, financial, or other relationships to influence official conduct or judgment.3 It's only the latest example of why we can't rely on Supreme Court justices to oversee themselves, and why Congress needs to take action to restore integrity to the court. The Supreme Court’s current code of ethics, adopted for the first time only recently, has no way of being enforced. Justice Thomas ruled in this case knowing that his own wife played an active role in attempting to overturn the 2020 election results, and we know Justice Thomas won’t hold himself accountable.4 This is after Thomas has heard other cases involving the attempts to overturn the 2020 election, and numerous cases throughout his career that are interwoven with his wife's activism and with the causes of right-wing financiers who also lavish expensive gifts on Thomas.5 It's time for Congress to step in and take action to bring trust back to the Supreme Court and stop further corruption! Congress has the power to prevent further corruption in the Supreme Court. The Supreme Court Ethics, Recusal, and Transparency Act would adopt a code of conduct for justices and create a system for investigating and receiving complaints. It would also establish rules for governing the disclosure of gifts, travel, and income received by justices.6

Together, we can call on Congress to impose commonsense ethics rules and ensure that our highest court respects precedent and stands up for the American people, not MAGA extremists and special interests.
