Just moments ago, the Supreme Court released their opinion in our case – and while the Court stopped short of removing Trump from the ballot, they did not exonerate Donald Trump for inciting insurrection.

John, let me say that again: Trump is an insurrectionist, and the Supreme Court does not dispute that fact.

The Court had the opportunity to clear Trump of the finding that he incited insurrection, and the Court chose not to. Instead it simply ruled that states do not have the power to enforce Section 3 of the 14th Amendment unless Congress says they can.

It’s disappointing that the Court failed to bar Trump from the ballot. This was a test for the Court, and it failed to meet the moment.

But in this ruling, there is a win for our democracy: Trump will go down in history as an insurrectionist.

We were the first group to bring a lawsuit that resulted in a court finding Trump responsible for the January 6th insurrection.

The precedent we set means that every court–and every decision-making body–that has substantively looked at the issue has found that January 6 was an insurrection, and Donald Trump engaged in insurrection. That remains true today. That’s a big deal—and as a supporter of CREW, you are a part of this victory.

This was the first time the Supreme Court heard a case on the insurrection. They let Trump off the hook on a technicality and allowed him on the ballot. But they did not exonerate him of the finding from our Colorado case that January 6th was an insurrection, incited by Trump.

Our democracy is facing an imminent threat, and one institution after another has failed to step up and use the tools our Constitution provides to protect us from that threat. Unfortunately, the Court just joined that list.
