What impact will the International Court of Justice (ICJ) proceedings in South Africa v. Israel have on the protection of free speech during conflict? In December last year, South Africa initiated proceedings against Israel before the ICJ under the Genocide Convention. The ICJ recently issued a legally binding order requiring Israel to implement
several provisional measures, including facilitating humanitarian assistance into Gaza and preventing breaches of the Genocide Convention.
However, amidst discussions on the legal aspects of the case, the freedom of expression issues highlighted by South Africa v. Israel have received less attention. The application by South Africa did, however, list many of Israel's violations of freedom of expression since Hamas's attack in October 2023, including journalist killings, censorship measures, and communication blackouts.
