Diversity and Equal Protection in Education
Dear John
Equal protection is a guaranteed right protected under the Fourteenth Amendment. However, challenges have arisen throughout history about how exactly this should be interpreted. One question concerning equal protection in the past few decades is the constitutionality of affirmative action and promoting racial diversity in education.
The Supreme Court recently declined to hear a case regarding the admissions policies at a prestigious Virginia high school that was designed to promote a more diverse student body. Our latest eLesson encourages students to form their own opinion on the constitutionality of policies like this, and helps you guide students through a discussion and civil debate on this challenging topic.
The question remains, do admission policies designed to promote greater racial diversity violate the principle of equality?
