On March 26, the U.S. Supreme Court will hear a case that could impact medication abortion access nationwide. Here's what you need to know and how you can help right now:
What's at stake?
Through the Alliance for Hippocratic Medicine v. FDA lawsuit, anti-abortion extremists are using junk science to threaten the U.S. Food and Drug Administration’s (FDA) decisions expanding access to mifepristone, one of two drugs used in medication abortion, and one of the safest drugs on the market in the United States. The Center for Reproductive Rights and partners have filed an amicus brief noting that other courts have routinely discredited the plaintiffs' evidence for lack of scientific integrity.
The plaintiffs have continually relied on “patently unreliable witnesses” and “ideologically tainted junk science” in their rulings.
Ultimately, this case could threaten medication abortion nationwide – even in states where abortion is legal. If the Supreme Court rules for the plaintiffs, antiquated, unnecessary restrictions on medication abortion could be reinstated, significantly reducing access to mifepristone, which has been essential in meeting the needs of patients now that 14 states have banned abortion entirely.
What is mifepristone?
Mifepristone is an extraordinarily safe and effective drug that has been used by more than five million women in the United States for abortion care since the FDA approved it more than two decades ago. It is also the most common method of abortion in the United States.
What is next?
The U.S. Supreme Court has scheduled oral arguments for this case on March 26. The Court will then issue its decision before July 4.
