This week, Alabama’s Supreme Court ruled that “Frozen embryos are children, and those who destroy them can be held liable for wrongful death.”

This ruling could set a dangerous precedent nationally, leading to other states attempting to define embryos as people. In fact, a religious group is already using the Alabama ruling as a precedent in a Florida abortion rights case.

Alabama’s new law will diminish the standard of care afforded to women struggling with infertility – it will be nearly impossible for IVF clinics to operate under these conditions.

According to CNN, “[Critics warn] it could send liability costs skyrocketing, making fertility treatment prices prohibitive for many families; it could discourage medical providers from performing infertility treatments in fear of being held liable each time an embryo does not turn into a successful pregnancy; and it could mean parents will now be forced to pay for lifelong storage fees of embryos they will never be allowed to discard, even if they don’t want any more children.”

Chief Justice Tom Parker invoked religion in his concurring opinion, “The People of Alabama have declared the public policy of this State to be that unborn human life is sacred. We believe that each human being, from the moment of conception, is made in the image of God, created by Him to reflect His likeness.”

As usual, this ruling has nothing to do with science. It has nothing to do with ethics. It is about controlling women’s bodies and stifling women’s autonomy when it comes to family planning. We will not allow these anti-choice lawmakers to keep making decisions that should be between Americans and their doctors.

This is why our 2024 priority is to elect pro-choice women, especially in states with abortion bans. The Democratic party cannot continue to leave American women behind just because they live in red states, and we’re going to take our candidates’ anti-choice, anti-science, anti-women opponents head-on.
