In December, we won before the Colorado Supreme Court and barred Donald Trump from the ballot under the 14th Amendment.
Last week, we went to the Supreme Court to defend that ruling. We brought this case because the Constitution requires it, and because democracy needs the protection this provision was adopted to provide.
When Trump appealed his loss to the Supreme Court, the case immediately became one of the most significant cases in American history.
What we asked the Court, and previous courts, to do is truly extraordinary. We’ve never been in a situation where a former president of the United States, the leading presidential candidate of one of our major political parties, could be removed from the ballot and removed for engaging in insurrection.
And the more that I look back on the amicus briefs filed by historians, legal scholars who have studied this far before January 6th happened and officials across the political spectrum, the more I believe that the Court’s decision in the case should be easy.
Section 3 of the 14th Amendment clearly applies to presidents, and it is the job of the courts to enforce it. I hope that as the justices dive into this case, they’re going to deliver what the Constitution and the law requires.
But I know there’s a real possibility that they won’t. If they don’t rise to the moment, and enforce the Constitution, then CREW will be back out there doing what we do best: fighting for democracy and fighting for accountability.

John, the future of American democracy is truly in danger. A person who lost an election and tried to keep himself in power by force is very realistically in a position to either become president again or to lose again and try to install himself by force.
Sadly, institution after institution is taking a pass on doing anything about it. That pattern needs to end at the Supreme Court.
If Section 3 of the 14th Amendment doesn't apply to the person who inspired and incited the only insurrection we’ve had since the Civil War, then it’s hard to imagine it applies to anybody.
