John, As the Supreme Court faces a crisis of confidence among the American public, the Senate Judiciary Committee has a responsibility to exert its authority in overseeing the federal judiciary. Last week, Justice Clarence Thomas heard arguments before the Supreme Court in Trump v. Anderson, a case that will determine whether or not Donald Trump will remain on the presidential ballot despite violating the Insurrectionist Disqualification Clause. Justice Thomas should not have been allowed to participate. He failed to recuse himself from this case and others regarding the 2020 presidential election where his wife, Ginni Thomas, has had a significant interest in the outcome of these challenges. Ginni Thomas was intimately involved in the Stop the Steal movement, sending numerous text messages to former Trump Chief of Staff Mark Meadows in an attempt to disregard the results of the November 2020 presidential election and keep Trump in power. Further, Federalist Society co-chair and conservative powerhouse Leonard Leo, who has paid Ginni Thomas tens of thousands of dollars in consulting fees, was found to have ties to several amicus briefs in support of Trump in this most recent case. This breach of conduct follows the bombshell report that Justice Thomas has accepted and failed to disclose hundreds of thousands of dollars in gifts and other financial benefits from Harlan Crow – the Republican billionaire and activist whose organizations regularly file briefs in the Supreme Court advocating positions that Thomas reliably adopts. Billionaires like Crow and Leo have spent decades shaping a right-wing majority on the Supreme Court, creating a corporatist majority that votes with their corporate backers at every opportunity and will influence policy for generations to come. This adhesion to big money interests corrupts our democracy, and the Senate Judiciary Committee needs to exercise its authority to address it. Tell Senator Dick Durbin, Chairman of the Senate Judiciary Committee: Issue the Subpoenas. The Senate Judiciary Committee has authorized subpoenas against Leo and Crow and a thorough investigation of the effects that corruption has today on the Court and its decisions. But now it is stalling on issuing those subpoenas. A rogue and unaccountable Supreme Court that is beholden to billionaires subverts our democracy. The Senate Judiciary Committee must act.
