Yesterday, the U.S. Supreme Court heard oral arguments for Trump v. Anderson, the case that will determine Donald Trump's eligibility to run for president.1 The court's ruling on this historic case will either finally hold Trump accountable for inciting a white-supremacist-led insurrection on January 6 or let him off the hook, allowing him to run for president despite violating the Constitution.
The justices could rule any day—and what they decide will have huge impact on the 2024 election. That's why we're preparing now for a rapid-response organizing call after they release their ruling. Section 3 of the 14th Amendment states that anyone who engages in an insurrection after "having previously taken an oath … as an officer of the United States" is disqualified from holding any state or federal office again.2 While it's clear to all of us that this applies to Donald Trump, the decision on whether to enforce the Constitution or capitulate to Trump's threats of retaliatory "chaos and bedlam" is now in the hands of the far-right Supreme Court.
And things aren't looking so good. In reporting on yesterday's oral arguments, The New York Times sent this headline: "A good day for Trump and his lawyers."3 It's reported that the justices on both sides are "skeptical" of the case to disqualify Trump from the ballot.
Now, we wait for a decision from the court, but we want to be ready when it comes down to take action immediately! If the court deems that Colorado can disqualify Trump from the ballot, we'll need to spring into action immediately to pressure states across the country to follow suit. If they determine he can remain on the ballot, we'll need to launch into our election program to defeat him at the ballot and also decry the court's refusal to enforce the Constitution against Trump!

For over a year, MoveOn members across the country have been urging secretaries of state and election officials to remove Trump from the ballot. And just ahead of Thursday's oral arguments, our petition to disqualify him reached over 500,000 signers!4 Together, we're making it clear that Trump is not above the law and must be held accountable for his role in attempting to overturn the 2020 election results and inciting the January 6 insurrection.
MoveOn recently coordinated the visual above with lights spelling out “Disqualify Trump” to ensure this message is front and center for press who are reporting on the case in the days ahead of yesterday's oral arguments. Various media outlets picked it up, including The Guardian and Newsweek.5,6 It's critical that grassroots support for Trump's disqualification is front and center!
