The U.S. Sentencing Commission (the Commission) wants to hear from you! The Commission, which writes the federal Sentencing Guidelines that judges use to determine a sentence, is proposing some changes we hope you will support.

One proposed change would end or limit the use of juvenile criminal history to calculate an adult criminal history score under the Guidelines. FAMM does not believe that adults should have their criminal history scores increased using convictions from their youth, and the proposed amendment includes an option that would end this practice entirely.
Another proposal would end or lessen the impact of acquitted conduct. When a defendant goes to trial and is found not guilty of one or more charges, one would expect that the judge would not be able to sentence the defendant using the conduct of which the defendant was acquitted. Sadly, this is not the case—but it can be, thanks to this proposal. We think the Commission should eliminate the use of acquitted conduct.
