Earlier this month, a federal judge ruled that Texas-based True the Vote did not violate the Voting Rights Act despite the Court’s “concerns about the manner” in which the group challenged the eligibility of more than 250,000 voters in Georgia's 2021 Senate runoff elections. Even though TTV’s challenges “utterly lacked reliability” and “verge[d] on recklessness,” the Court did not order TTV to stop its challenge activity in the 2024 election cycle and beyond.

This is not the outcome we sought when we took True the Vote to court for alleged voter intimidation — and it makes our ongoing work fighting back against mass voter challenges even more critical.

Absent court-ordered relief, voters will continue to rely on groups like Fair Fight and our partners to navigate mass challenges and be able to access the ballot box freely and fairly. That’s why we will not and cannot back down from the fight against ongoing attempts at voter suppression and intimidation. And given the threat of additional mass challenges this year and beyond, our work is more important than ever.

Because of this ruling, we are preparing for True the Vote to double down on its use of mass challenges. After all, while our trial was underway, True the Vote’s founder said, "2024 is going to be one for the ages, and this is just a warm-up act." That means we must be ready for a new wave of mass challenges that, as stated in the court’s opinion, carry “a high risk of false positives" and "are more likely to [affect] minority voters than white voters."

We'll keep pushing back against mass challenges and protecting the freedom to vote — but we can’t do it without grassroots support.
