Trump and Mitch McConnell are trying to jam-pack our courts with unqualified and radically far-right judges for decades to come – and they’re succeeding. Trump has nominated Stephen S. Schwartz for the U.S. Court of Federal Claims, despite the fact that much of his record is so blatantly disqualifying that he should be unconfirmable for a federal position.
Perhaps Schwartz’s biggest claim to fame? He was a lead defender of the North Carolina voter suppression bill that a federal court decision later described as having “target[ed] African Americans with almost surgical precision.”1

In addition to his record of hostility to voting rights, Schwartz is attractive to the Radical Right for:
- arguing that Title IX does not prohibit discrimination against transgender students;
- defending North Carolina’s notorious anti-transgender “bathroom ban bill;”
- arguing that states could legally deny driver’s licenses to DACA participants because Schwartz thought that the 2012 program was not lawful.
Those are just some of his many extreme positions, and if he were to be confirmed to the powerful U.S. Court of Federal Claims, Schwartz would be able to do even greater damage to our legal system and Americans’ rights.

Schwartz was first nominated for this position in 2017, but his far-right political ideology prevented him from getting a vote back then. Now Senate Republicans are making a second attempt to put this right-wing ideologue on the federal bench – a position he is completely unqualified to serve.
