Dear Friend, |
We’re defending the Good Neighbor Rule at the Supreme Court to stop deadly air pollution across the United States. |
The Environmental Protection Agency (EPA) instituted this historic rule in 2023, but now polluters and polluter-friendly states are asking the Supreme Court to suspend the rule — potentially costing thousands of lives in the years of subsequent litigation. |
We already submitted written arguments to the Supreme Court, and are helping our allies prepare for oral arguments in just 4 weeks. Support our work with a monthly donation to Earthjustice today, and your first 12 months of donations will be matched $1:$1. |

The Good Neighbor Rule requires states with lax air pollution regulations to improve their standards if their air pollution affects other states. This is a massively consequential and historic rule, which would prevent thousands of premature deaths and reduce asthma attacks for millions of Americans. |
These are the public health benefits the EPA predicts for 2026 alone: |
- Preventing approximately 1,300 premature deaths
- Avoiding more than 2,300 hospital and emergency room visits
- Cutting asthma symptoms by 1.3 million cases
- Avoiding 430,000 school absence days
- Avoiding 25,000 lost workdays
|
Air pollution does not stop at state borders. So states like Texas with lenient pollution controls can have massive negative health consequences for other states across the country. |
In this map, yellow states are ones the Good Neighbor Rule requires to improve their pollution standards, and red arrows show where their pollution travels. |
|
In this case, Earthjustice is submitting arguments to the Supreme Court in support of the EPA. The Supreme Court will decide whether to stay — or pause — the Good Neighbor Rule while polluters attempt to strike down the rule on its merits in a lower court. But litigation could take years, so a stay of this rule could result in thousands of premature deaths. |
Earthjustice is the legal backbone of the environmental movement, and since we represent our clients for free, we rely on the generous support of donors to continue our fight for a healthy planet. Monthly donations are an indispensable source of financial stability for our work, so for the rest of January, all new monthly donations will be matched $1:$1 for their first 12 months. |
Friend, can you support our work by starting a monthly gift today? Our goal is 425 new monthly gifts to power our work this year and into the future. |
