John,
We’re going to the Supreme Court on February 8th to defend our lawsuit win and keep Trump off the ballot in Colorado.
We’ve been overwhelmed—in the best way—by the public support for our work enforcing the 14th Amendment, from columns in leading magazines and newspapers to late night TV!
Just as Stephen Colbert said, the only person Donald Trump can blame for his disqualification from the Colorado ballot is himself.
Trump incited insurrection after swearing an oath to defend the Constitution. The court simply enforced Section 3 of the 14th Amendment.
If you support our efforts to keep Trump off the ballot, we’re asking for your help. Please make a donation to CREW to help fund all our efforts to hold Donald Trump accountable →

If you want to go deeper on what people are saying about our lawsuit, we’ve got you covered.
In an Atlantic article entitled “January 6 Is Exactly What the Fourteenth Amendment Was Talking About,” Quinta Jurecic wrote:
“...just as there are risks to barring him, there are also risks to disregarding the clear command of the Fourteenth Amendment. The section of the Amendment at issue—Section 3—sets certain conduct outside the bounds of what’s acceptable for public officials in a democratic society … a brutal effort to unlawfully derail the peaceful transfer of power, January 6 falls well within the range of conduct forbidden by Section 3. What message would the Supreme Court send if it closed its eyes to that prohibition—especially in the months before yet another presidential election with the threat of violence hanging over it?”
John, like Jurecic says, Section 3 is just about as democratic as it gets. It is intended to ensure that insurrectionists who sought to overthrow the government once are not given a chance to join – or lead – that very government again.
Jamelle Bouie also weighed in in The New York Times:
“There is no rule that says democracies must give endless and unlimited grace to those who used the public trust to conspire, for all the world to see, against them. Voters are free to choose a Republican candidate for president; they are free to choose a Republican with Trump’s politics. But if we take the Constitution seriously, then Trump, by dint of his own actions, should be off the board.”
In 2020, Trump was on the ballot, asking voters for another four years in office – but the majority of the country said no. Trump was already defeated at the ballot box once. He refused to concede and incited a violent insurrection – and since then, has continued to push his lies about voter fraud and a rigged election.
Trump has expressed no remorse for his actions and has even promised to pardon January 6th insurrectionists. He must not get another chance to overturn the results of a free and fair election, according to the Constitution.
As Adam Serwer wrote for The Atlantic, the only question is whether the Court will step up and do the right thing:
“There is little factual dispute over whether Trump attempted to seize power by fraud—pressuring state and federal officials to alter the election results—and then force, in the form of sending a mob to coerce Congress into reversing the election results. The real question is whether the Fourteenth Amendment’s ban on candidates who have broken an oath to defend the Constitution by engaging in ‘insurrection or rebellion’ should be enforced.”
There’s no question in our minds that it should be.
Since the day Trump took office, CREW has been fighting to hold Trump accountable whenever he has violated the law. This case we are bringing to the Supreme Court is our biggest fight yet, so if we’re going to succeed, we’re going to need the support of thousands across the country.
