** Dear Indian River County Democrats,
------------------------------------------------------------

Your prompt action is crucial before Wednesday, January 10th!

The Senate Environment and Natural Resources Florida committee is set to hear and vote on SB 738 titled Environmental Management, a bill that threatens to reshape environmental justice in our state. This legislation would drastically impact the ability of individuals and environmental groups to defend Florida's natural resources by imposing exorbitant financial burdens on those challenging the Department of Environmental Protection or water management districts.

Your advocacy matters. Whether by email or phone call, your voice will be instrumental in safeguarding our environment and preserving our rights to uphold Florida's environmental laws.

Please reach out to the Senate committee members and urge them to vote NO on SB 738.
Phone an email scripts are provided below for your convenience.

Suggested Script for Calling Senate Offices
(leaving voicemails is okay)

Hello, my name is __________ and I am calling today to ask that you vote NO on SB 738 when it is heard by the Environment and Natural Resources committee on Wednesday.

Section 1 of SB 738 requires the losing party in environmental challenges to pay the court costs and attorney fees of the other parties, including state agencies.

SB 738 is not intended to stop frivolous lawsuits, but to deter and punish non-profits and Floridians who successfully litigate to ensure that the laws passed by the Legislature are enforced and Florida’s environment is protected.

Please protect Floridians and Florida’s environment by voting NO on SB 738. Thank you.
Suggested Script for Your Email Communication

Dear Senator,

Please vote no on Senate Bill 738 - Environmental Management - when it is heard by the Senate Environment and Natural Resources Committee on Wednesday, January 10th.

Section 1 of SB 738 requires the losing party in environmental challenges to pay the court costs and attorney fees of the other parties, including state agencies. If passed, this bill will make going to court to enforce environmental laws and rules financially impossible for individuals and non-profits, because every environmental challenge will be a life-or-death fight against state agencies with multi-billion dollar tax-payer funded budgets. One loss would mean the end of the non-profit, or financial ruin of the individual, bringing the challenge to protect Florida’s environment.

Frivolous lawsuits are already subject to sanctions and mandatory attorney fees.

Sincerely,
