Trump's lawyer recently told Fox News that she expects the Supreme Court to step up, notably Brett Kavanaugh: "who the president fought for, who the president went through hell to get into place, he'll step up." Three of the Court's nine justices were appointed by Donald Trump.

These threats call into question the impartiality of a Court that is already facing a credibility crisis. Clarence Thomas—whose wife actively aided and abetted Trump's efforts to overturn the 2020 presidential election—must be made to recuse himself in this upcoming case.

Back in November, the U.S. Supreme Court passed a (non-binding) code of conduct to regulate such conflicts of interest. Specifically, it said that justices must recuse themselves in cases if their spouse has an interest "that could be substantially affected by the outcome of the proceeding." Ginni Thomas' active efforts to help Trump overturn the 2020 presidential election goes directly to his insurrection activities that have disqualified him from the ballot.

The Court faces a serious credibility crisis. Having Clarence Thomas recuse himself from this case would only be the first required step to restoring public confidence.

The case now goes to the U.S. Supreme Court, which will make one of the most consequential decisions since Bush v. Gore was decided more than 23 years ago.

The 14th Amendment to the Constitution is clear: those who engaged in insurrection (after taking an oath of office) are disqualified from running for public office. What Trump did to incite his supporters on January 6th was unprecedented and requires this extraordinary response.

Clarence Thomas has no business ruling on this case, and must recuse himself. After it was clear that Joe Biden had won Arizona and Wisconsin, Thomas' wife Ginni pressured legislators in both states to appoint a rival slate of electors to award them to Trump. She also regularly contacted Trump chief of staff Mark Meadows in a series of text messages after the 2020 election and before January 6, urging him to “help this Great President stand firm."

The U.S. Supreme Court's credibility is on the line. As it decides whether Donald Trump can remain on the ballot, the justices cannot risk another flawed decision with a glaring conflict of interest. Removing Clarence Thomas from hearing this case would be a good first step.
