Since January 6th, 2021, CREW has worked hard to make one thing abundantly clear: The Constitution bars Donald Trump from the ballot and from serving as president again.
The six voters on whose behalf we brought the Colorado lawsuit agree. And the Colorado Supreme Court agreed too.
But some pundits and politicians are claiming our lawsuit and this ruling are politically biased. And Donald Trump appealed our ruling because he refuses to accept that there’s only one person to blame for his disqualification: himself.

The Constitution sets out the rules for our democracy. For example, it states that the president must be at least 35 years old. Few would argue that people should be allowed to vote for a 23-year-old for president because of that rule.
Our argument is to hold Donald Trump to these very constitutional rules. There’s nothing more democratic than holding people accountable to the Constitution, through the courts.
And as Rep. Jamie Raskin recently pointed out: “If you think about it, of all of the forms of disqualification that we have, the one that disqualifies people for engaging in insurrection is the most democratic because it’s the one where people choose themselves to be disqualified.”
The 14th Amendment’s Disqualification Clause was put in place specifically to secure our government from those who threaten it.
Section 3 of the 14th Amendment makes it clear that anyone who swears an oath to support the Constitution and then engages in insurrection against that same Constitution is disqualified from state or federal office.
If we don’t enforce the rule, this crucial protection for our democracy — and our system of constitutional democracy itself — will start to fade away.
This is not “a left-wing group’s scheme to interfere in an election on behalf of Crooked Joe Biden,” as Donald Trump’s campaign spokesperson alleged. In fact, we brought this lawsuit on behalf of six Republican and unaffiliated Colorado voters.
This lawsuit is about holding Donald Trump accountable to the Constitution and protecting our democracy.
Donald Trump is claiming that the January 6th insurrection was nothing to worry about and not a real threat to the democratic process—while pushing the idea that our lawsuit is somehow anti-democratic. I can’t help but notice the irony there.
Trump violated the terms of the Constitution — the sacred contract of our democracy. That is the law of the United States, and we will do everything in our power to enforce it.
