John – A few months ago I wrote to you about a critical abortion case here in Idaho.
After our Republican-controlled state legislature made it a crime for emergency room physicians to perform an abortion, even if the patient’s health was in jeopardy, the DOJ invoked the Emergency Medical Treatment & Labor Act (EMTALA) mandating emergency care – and sued our state for violating federal law.
The DOJ lost that suit, and the women of our state lost their federally-protected right to life-saving emergency healthcare.
But we always knew this wasn’t going to stop with Idaho.
Every state strangled by Republican rule is in a race to the bottom to criminalize all abortions and endanger women’s lives.
Enter Texas, stage right.
Texas governor Greg Abbott and attorney general Ken Paxton sued the Biden administration over the DOJ’s enforcement of EMTALA, calling it a “mandate” for abortions nationwide.
Let me be clear: If a pregnant person’s life is on the line and an abortion is the treatment medically required, then you’d better believe it’s a mandate.
The three Fifth Circuit judges – two appointed by Donald Trump and one by George W. Bush – apparently think they know more than medical doctors or the patients in their care. They claimed that the “stabilizing care” mandated under EMTALA does not include access to an abortion, even in life-threatening emergencies.
There’s no question this case or the Idaho case will end up in front of the Supreme Court, and after they tossed out Roe we can guess how that decision is going to come down.
But John, there is a path forward out of this national nightmare. If we re-elect Joe Biden, hold the Senate majority, and fight for every single House seat we can to flip the House back for Democrats – we can pass a federal law protecting reproductive freedoms.
