Impartiality is always important in Supreme Court cases, but never more so than in Trump’s appeal of the Colorado Supreme Court’s decision barring him from the state’s primary ballot under the 14th Amendment.
Justice Clarence Thomas’ wife Ginni was directly involved in trying to overturn the 2020 presidential election. She pressured lawmakers in Arizona and Wisconsin to overturn Biden’s legitimate victory in those states.
Ginni Thomas also took an active role on January 6 itself, the day of the violent insurrection that led to five deaths. On that day she texted a series of messages to Trump Chief of Staff Mark Meadows. She didn’t suggest that Trump call off the mob that was at that moment using sharpened flagpoles to beat Capitol Police officers risking their lives to protect the U.S. Capitol. No, she told Meadows to “help this Great President stand firm.”
Under these circumstances, there is no way Justice Thomas can claim to remain impartial.
Clarence Thomas should not rule on the question of whether Donald J. Trump should be barred from office under the 14th Amendment. Demand Justice Thomas recuse himself from the Colorado election case disqualifying Trump from the ballot now.
Who can forget the Confederate flag flying in the Capitol on January 6?
It was the first time in history. No Confederate flag had ever flown in the U.S. Capitol before, not even during the Civil War.
The Colorado Supreme Court’s decision is based on the 14th Amendment to the Constitution, enacted after the Civil War to prevent ex-Confederates who had risen up against our democracy from holding any public office, most certainly including the presidency.
With equal certainly, that means, Donald Trump is disqualified. That’s the view of the Colorado Supreme Court and, as of last week, the Maine Secretary of State too. But despite how straight forward it is in the law, this Supreme Court may bend over backwards to try and find a way out of it.
Ginni Thomas worked to overturn the election. Justice Clarence Thomas is not impartial. He must recuse himself now. For Justice Thomas to rule on this case would be a grave injustice not only to this historic ruling, but also to American democracy itself.
Let’s call for Justice Thomas to recuse himself immediately by adding your name now.
