Donald Trump just appealed his loss in our Colorado 14th Amendment lawsuit to the U.S. Supreme Court.
From the moment the Colorado Supreme Court announced its decision to bar him from the ballot, Trump has been promising to appeal to the Supreme Court. He just acted on that promise.
We have already asked the Court to move quickly to give voters across the country the answers they need about this urgent question. With two states—Colorado and Maine—barring Trump from the ballot over the last two weeks, the momentum is on our side.
It is no coincidence that Donald Trump was barred from the ballot in the only two states that have grappled with whether the 14th Amendment applies to Trump. In the states where these challenges have failed, it has been on state law grounds regarding timing or who has the standing to bring a challenge.
John, the Constitution is clear on this point: Insurrectionists who swore an oath to protect the Constitution are disqualified from public office. They do not get a second chance to overthrow our democracy.
The Supreme Court will now have to make a decision about how the plain text of the Constitution should be enforced.
