But now the case goes to the U.S. Supreme Court, and Justice Clarence Thomas cannot rule. His wife Ginni aided and abetted Trump's effort to overturn the 2020 presidential election.

Senator Richard Blumenthal (D-CT) has asked Chief Justice John Roberts to remove Thomas from hearing the case. Beyond the fact that judges are required to recuse themselves in cases where their impartiality can be called into question, there is strong precedent for this matter.

In October, Thomas recused from deliberations as to whether the court should take an appeal from John Eastman, the architect behind many of Trump’s efforts to overturn the 2020 election.

The Colorado decision to disqualify Trump from the 2024 ballot was sound, as it provided ample evidence that he engaged in the kind of "insurrection" contemplated by Section 3 of the 14th Amendment. But we cannot trust Clarence Thomas to rule on this case fairly, when his own wife actively took part in Trump's various efforts that resulted in the violent January 6 insurrection.

The Colorado Supreme Court has ruled that Donald Trump's involvement in the January 6th insurrection makes him ineligible to run for president. The 14th Amendment to the Constitution, written after the Civil War to prevent ex-Confederates from holding public office, applies here.

While the decision is historic and consequential, the ruling is solid on both the facts and the law. But the case will now go to the U.S. Supreme Court, where it may get overturned.

Justice Clarence Thomas has no business hearing this case and should recuse himself. His wife, Ginni, was actively involved in the effort to overturn the 2020 presidential election.

After Joe Biden had won Arizona and Wisconsin, Ginni Thomas pressured legislators in both states to appoint a rival slate of electors to award these states to Donald Trump. She also regularly contacted Trump's chief of staff Mark Meadows in a series of text messages after the 2020 election and before January 6, urging him to “help this Great President stand firm."

Judges must recuse themselves from cases where their impartiality may be questioned. This is especially important at the U.S. Supreme Court, which will likely have the final say on this matter. Given the nature of this case, Ginni Thomas' overt advocacy that led to the January 6th insurrection makes it clear that her husband cannot rule on Donald Trump's eligibility.
