Having successfully navigated the majority of his ballot access lawsuits nationwide, former President Donald Trump faces another legal challenge in Maine, where a decision on his eligibility for the state's Republican primary is anticipated on Friday. Maine Secretary of State Shenna Bellows will determine whether Trump, the GOP frontrunner, can participate in the March 5, 2024 primary amid claims that an insurrectionist clause in the 14th Amendment disqualifies him.
The recent decision by the Colorado State Supreme Court, branding Trump as engaged in insurrection and directing the withholding of his name from the ballot, has stirred widespread outrage. Trump's campaign has pledged to appeal this unprecedented ruling to the U.S. Supreme Court. Trump had previously emerged victorious in over half a dozen ballot access challenges, with most courts or secretaries of state dismissing suits on grounds of lack of standing by the plaintiffs.
The Maine lawsuit, initiated in part by Democrat Ethan Strimling, former Mayor of the progressive Portland, and Republican former state Sen. Kimberly Rosen, echoes arguments made in Colorado. They contend that Trump's words and actions around January 6, 2021, amounted to inciting insurrection during the certification of President Joe Biden's victory.
During last Friday's hearing, Maine resident Mary Anne Royal of Winterport asserted that Trump "willfully violated his oath of office," and someone who has done so "can never be trusted to hold public office again." Trump's attorney, Scott Gessler, countered that his client did not engage in insurrection, emphasizing that decisions about presidential candidates' eligibility rest with Congress, not individual state officials or courts.
Two additional appeals seek to prevent Trump from being on the Maine ballot, with one playfully citing Trump's claim of winning the 2020 election and arguing that, as he won a second term, he would not be eligible for a third. Secretary Bellows is expected to deliver her final decision on Friday, though her office notes that it is not a strict deadline.
