The Texas Supreme Court has nine justices — and zero doctors. Yet when asked to rule on the fate of Kate Cox, a 31-year-old mother of two hoping for a third, these judges placed their political bias above the medical experts who said Ms. Cox’s health was endangered and her baby would not survive.

With a conservative Supreme Court and opposition in Congress, there is little hope for federal action. So, America, here’s the opportunity: This battle can be won in the states. Since Dobbs v. Jackson Women’s Health Organization , every ballot initiative protecting reproductive rights has passed and every state attempt to restrict a woman’s right to choose has failed.

The health of millions of women is on the line. While our democracy is still intact, let’s unite and take the most democratic action: put the question of abortion access to a vote.

And that’s exactly what New York is going to do. In 1848, Seneca Falls was the birthplace of the women’s rights movement, and New York women have led on the issue of reproductive freedom. Since I became our first female governor, we’ve enacted landmark protections for reproductive health care, shielded doctors from MAGA extremists and launched a nation-leading $35 million fund for clinics.

And though abortion rights are protected under state law, in November next year, New York will put reproductive rights to a vote by the people. Voters will have the opportunity to enshrine abortion access in the state constitution, ensuring that future governors and legislators cannot trample on the rights that we hold so dear.

Women in Texas and across the country deserve the same opportunity to vote for their own rights and for a better future. If any state won’t allow the right to vote on freedom for women, then women should vote with their feet. New York will always stand up and fight for women.
