Daily Docket — Monday, Dec. 18

Here are some recent updates.

  • The 5th U.S. Circuit Court of Appeals upheld a Texas law that effectively prevents electronic voter registration by requiring a pen-on-paper signature. But in a win, the court rejected Texas' argument that private parties can't sue under part of the Civil Rights Act.

  • House Democrats asked Supreme Court Justice Clarence Thomas to recuse himself from former President Donald Trump’s Washington, D.C. election subversion case.

  • The 11th U.S. Circuit Court of Appeals ruled that Mark Meadows' indictment in Fulton County, Georgia will remain in state court. This decision affirms the lower court's ruling, marking the second rejection of Meadows' request to move his case to federal court.

Here’s what to expect coming up.

  • Tomorrow there will be a hearing in a federal lawsuit seeking to block provisions of Mississippi’s new anti-democratic law that create a new court in Jackson — a predominantly Black city — with a judge and two prosecutors who are appointed by white, conservative state officials.

ICYMI, listen to our latest episode of Defending Democracy. In the podcast episode that dropped last Friday, Marc and Paige discuss the 14th Amendment challenges facing Trump. Republicans have decided that they will live with being the party that may go down in history as having successfully attacked American democracy, Marc argues.
