John, Donald Trump knew exactly what he was doing on January 6th.
He urged a crowd of his armed, angry followers to “fight” – right before they stormed the Capitol.
And that was just the finale of his desperate, months-long attempts to overrule the will of the people and hold onto power.
These facts led a Colorado judge to officially declare, for the first time in history, that a United States president had engaged in insurrection against the United States.
John, an unprecedented crime like this merits an unprecedented response.
That’s why Common Cause filed a brief under the 14th Amendment to disqualify Donald Trump from the Colorado ballot in the 2024 primary – and with it, the general election. [1]
This isn’t just some legal theory – it’s plain constitutional common sense. The 14th Amendment of the U.S. Constitution bars any officer of the United States who has previously taken an oath to support the Constitution from holding office if they have engaged in insurrection or given aid or comfort to insurrectionists.
This same constitutional language was used to successfully remove a January 6th rioter from his office as a New Mexico county commissioner – and that was just for participating in the attack, not leading it!
Even prominent conservative law professors agree: “Donald Trump cannot be president – cannot run for president, cannot become president, cannot hold office – unless two-thirds of Congress decides to grant him amnesty for his conduct on Jan. 6.” [2]
