I’m writing to you from Colorado, where we’re taking legal action to hold Trump accountable for January 6th – by urging our state’s Supreme Court to remove him from the ballot under the 14th Amendment. [1]

Barring a former president from the ballot would be an unprecedented move – but one that is necessary after he showed us he’s willing to destroy the very foundation of our democracy in order to cling to power.

After the Civil War, we wrote the 14th Amendment into our Constitution to ensure anyone who had "engaged in insurrection" against the United States wouldn’t be allowed to hold office again.

And John, can you imagine a more clear-cut modern example than what Donald Trump did after he lost in 2020? What else can you call sending an armed mob to the U.S. Capitol to disrupt the peaceful transition of power?

A Denver district court agreed on all of those facts last month, declaring that the former president engaged in insurrection – but ruled that this part of the 14th Amendment shouldn't apply to the presidency.

But John, you and I saw firsthand how dangerous it is when a president is willing to do anything to hang onto power. At Common Cause, we believe no one is above the law, especially not a disgraced, twice-impeached former president.
