Brief Description:?The purpose of this rulemaking is to amend Chapter 296-46B WAC, Electrical safety standards, administration, and installation, to adopt the 2023 edition of the National Fire Protection Agency (NFPA) 70, the National Electrical Code (NEC), and other related codes for electrical. The 2023 NEC (NFPA 70-2023) would replace the current 2020 NEC (NFPA 70-2020) adopted standards.

The Electrical Program reviewed the existing rules and 2023 NEC (NFPA 70-2023) to update rules for consistency with the latest national safety standards and industry practice. The 2023 edition of the code presents the latest comprehensive regulations for electrical wiring, overcurrent protection, grounding and installation of equipment.

Washington?s electrical stakeholders and other interested parties were invited to participate in the review process, submit proposals and provide recommendations to L&I for possible rule amendments. A Technical Advisory Committee (TAC) of industry experts and the Electrical Board reviewed the proposals and provided recommendations on adoption of the rules. This rulemaking is necessary to adopt the latest safety codes, and other amendments to the rules identified during the formal review process and recommended by stakeholders to improve public safety.

Topic:?*Adoption (CR-103) ? Prevailing Wage - Intents and Affidavits (2SSB 5268 Implementation)*

Brief Description:?The purpose of this rulemaking is to update the threshold amount in WAC 296-127-050 under Chapter 296- 127 WAC, Prevailing wage, from the outdated $2,500 threshold used by awarding agencies of the alternate filing procedures (combined intent & affidavit form) on public works projects, to be consistent with recent changes to RCW 39.12.040, Statement of Intent to Pay Prevailing Wages. In order to avoid future rulemaking if the statutory amount is changed in the future, L&I is removing the dollar amounts in rule and cross-referencing directly to the statute (RCW 39.12.040).

Topic:?*Preproposal (CR-101) ? Medical Aid Rules - Conversion Factors*

Brief Description:?The purpose of this rulemaking is to update the Medical Aid Rule rates for most professional health care services for injured workers. These updates may also impact rates for health care services provided to crime victims. The current rules describe elements used in the process of updating the maximum allowable payments for most professional health care services. These elements are set in rule in order to follow the established methodologies of L&I and maintain consistency with the Health Care Authority and Medicaid Purchasing Administration. Specifically, any proposed rule changes will consider the following:


* WAC 296-20-135: Updating the conversion factors used by L&I for calculating reimbursement rates for most professional health care and anesthesia services. Updating the conversion factors to correspond to changes in the medical procedure codes, the relative value units, and anesthesia base units. These changes would enable L&I to continue a reimbursement methodology consistent with other state agencies. Cost-of-living adjustments may be incorporated into the changes in the conversion factors.
* WAC 296-23-220 and 296-23-230: Updating the maximum daily reimbursement level for physical and occupational therapy services so L&I may, if necessary, give cost-of-living adjustments to affected providers.
