John — we're reaching out to ask you to take action on a critical issue that affects the rights and well-being of au pairs and, by extension, all domestic workers [[link removed]].

The U.S. State Department has recently proposed new rules for the J-1 Au Pair Program. While these new rules include important improvements to ensure fair pay for au pairs, they also jeopardize labor protections that au pairs and other domestic workers have fought hard to win under federal, state, and local laws.

The proposed rules not only go beyond the State Department's authority but also create an au pair underclass of domestic workers, leaving them vulnerable and undermining protections for workers across various sectors.

Here's what you need to know:

WHAT'S GOING ON

Au pairs are live-in childcare workers who come to the US on temporary J-1 visas in order to work and study. Currently au pairs, like other domestic workers, have workplace protections under some state and local laws. Things like minimum wage, overtime pay, sick leave, protection against harassment and discrimination, and more.

The State Department wants to change the rules and take away these hard fought rights, like protection from harassment and discrimination, and even workers' comp.

This would make au pairs more vulnerable to abuse and exploitation, and make it tough for other domestic workers to compete for fair treatment in the job market.
