I know I just emailed you on Monday, but since then, the Center for Reproductive Rights has brought yet another groundbreaking case in Texas that you need to know about.

Yesterday morning, we filed a lawsuit on behalf of Kate Cox, a pregnant woman who has received a devastating fatal fetal diagnosis and is at high risk of multiple serious medical conditions if she continues her pregnancy. Kate needs an abortion, but because of Texas's cruel and dangerous abortion bans, she can't get access to the emergency care she urgently needs.

Kate's only option in her home state of Texas is to sue, and if the court doesn't allow her to get an emergency abortion, she'll face a set of agonizing choices: if she can't leave the state to get medical care, she will be forced to remain pregnant until she miscarries, give birth to a stillborn, or have a baby that could live only minutes. It does not have to be this way: the Texas abortion bans—and the politicians who voted for them—have made it this way.

Health care is a right that should never be denied. We brought this suit—the first of its kind since the U.S. Supreme Court's 1973 decision in Roe v. Wade—to insist that the court grant Kate access to the abortion care she needs.

When she was 20-weeks pregnant with her second child, Kylie and her husband learned that the baby had a fatal condition in which the head grows abnormally quickly and was unlikely to survive past birth. Kylie begged to be induced at an earlier gestation so she could deliver vaginally, but her doctors were unable to due to Texas's abortion bans. After rushing to the hospital in severe pain at 35 weeks, Kylie was finally sent for an emergency Cesarean. Her baby died four days after he was born, and Kylie now fears for her health, safety and ability to get pregnant again in the future. By denying health care to pregnant people, Texas and other states like Idaho, Tennessee and Oklahoma are robbing people of their constitutional rights to health.
