Hey John, do stories about cronyism and government control annoy you? Well, wait till you hear about Certificate of Need (CON) laws...

‌

CON laws require health care providers to obtain approval — a permission slip — from state officials before investing in facilities, services, or equipment. In 1974, Congress mandated states establish CON laws to be eligible to receive certain federal health care funds.  

‌

Because incumbent providers have a CON, and often have the resources and lobbyists to work bureaucratic systems, they fare better than start up innovators struggling to gain a foothold in the market and in the halls of power.

‌

While federal lawmakers rarely remove laws from the books, in 1987 even Congress recognized CON laws were a failure and lifted their mandate.  

‌

At least a dozen states followed by repealing their CON laws. Still, at the beginning of 2023, 35 states still had CON laws in place. 

‌

Now only 34 will.

This groundswell of support was truly remarkable, and the commitment of activists—regular Americans like you—to this cause made a tangible difference.

South Carolina State Senator Wes Climer is clear: “Certificate of need would not have been repealed if AFP had not played a leading role.”
