We have new developments in the fight to overturn Idaho’s abortion ban – the most extreme ban in the nation.

 

First, a quick recap of how we got here:

 

  • SCOTUS overturned Roe in June 2022.

  • Idaho almost immediately passed a TOTAL abortion ban with limited exceptions for life of the mother and rape or incest.

  • Rural Idaho hospitals began shutting down maternity services in early 2023, citing “political climate” and legal liabilities related to the ban.

  • The DOJ fought back, citing federal law that requires doctors to perform life-saving emergency care – including abortions – and put the ban on hold.

  • Two months ago a federal court reversed that decision, meaning that unless they can prove in court that a patient definitely would have died without an abortion, Idaho doctors risk losing their license AND prison time if they try to save a pregnant woman’s life.


Now the latest: While the case is still tangled up in the courts pending appeal, Idaho has gone straight to the Supreme Court – the same court that tossed out Roe – for a definitive ruling fully reinstating the ban until the appeals play out.

Meanwhile, Idaho’s maternal mortality rate has SKYROCKETED by 122% over Pre-Roe levels and our doctors aren’t allowed to perform emergency abortions even when the woman’s bodily functions, limbs, or organs will suffer permanent damage without one.

 

Democrats are fighting to protect abortion rights nationwide, while Republicans in Congress – including the new House Speaker – have sworn to pass a nationwide abortion BAN. Help me flip ID-02 next year so they never get the chance.

This isn’t just Idaho, John. There’s a similar case pending in Texas, where dozens of women who were denied emergency care during pregnancy and nearly died as a result are suing to overturn their state abortion ban.

 

Idaho women will die because of this law, and doctors will leave the state. And if this law is allowed to stand, more states will copy Idaho and Texas with draconian abortion bans that shatter lives.

 

We only need 5 seats to take back the House majority for Democrats to stop the GOP’s plot to ban abortion everywhere – and we need to fight for every possible seat.
