This Giving Tuesday, I want to highlight an IJ client who embodies the entrepreneurial spirit at the heart of the American Dream: Marc N’Da. Marc came to this country as a political refugee from the African nation of Togo and has since built a home health care business in Nebraska. He wants to expand his business, but a law that lets industry incumbents veto his plans stands in his way.
Recently, a trial court in Nebraska upheld this law. That means Marc isn’t allowed to offer new services—like non-emergency transport to take his clients to doctor’s appointments or to pick up prescriptions—without permission from his competitors.
But that isn’t the end of Marc’s story—very far from it. We’re now on a path to the state supreme court, where a victory there has the potential to unleash opportunity not only for Marc but for all entrepreneurs in Nebraska to start or grow their businesses.
Many of IJ’s most powerful victories came after initial losses in the trial court, like the one we just saw in Nebraska. That’s because the transformative legal change we seek often requires higher courts to chart a course away from old precedent that blindly deferred to government regulators. So we aim to set precedent at the highest courts in the land to instruct judges to enforce the Constitution and affirm the freedoms we hold most dear—not just in our own cases, but for countless others who have the courage to assert their rights and challenge government overreach.
