Over the past few decades, the Left has been slowly but surely taking over our American legal institutions. Judges, lawyers, law schools—no matter where you look in the jurisprudential ecosystem, liberals dominate. So, it should come as little surprise when lawfare is aimed toward conservatives. After all, we so rarely fight back.
But late last week something interesting happened. A Colorado judge rejected an attempt to keep former President Donald Trump off the state’s primary ballot. This constituted the first such decision based on substantive, rather than procedural, grounds. It was a tremendous legal victory for free and fair elections in America.
And for this win, conservatives owe a debt of thanks to Robert Delahunty, a Washington Fellow at Claremont’s Center for the American Way of Life. It was Robert's testimony in the Colorado case, along with an 86-page legal analysis, that provided the winning argument. This work will now serve as a legal roadmap for similar cases across America.
