November 10, 2023 The Friday File Donate Now KSGOP CLICK HERE Michigan Judge Says Trump on Ballot Legal Battles Rage in Colorado, Other States The Kansas Republican Party joined in support of the Michigan Republican Party in an amicus brief filing along with several other states in a Michigan Court of Claims case where fanatical liberal leftist groups are trying to use the 14th Amendment to keep President Trump off the ballot in that state. The KSGOP joined the suit as Kansas Republican voters would suffer harm as the current Republican front-runner in our state would not be eligible to receive the delegates of other states, thereby diluting our votes and causing us damage or harm. This argument gave us standing in the case, and we exercised that standing at no cost to the KSGOP. The American Center For Law & Justice (ACLJ), the lead law group in multiple states, is a conservative legal group founded in 1990 with the mandate to protect religious and constitutional freedoms. It engages in legal, legislative, and cultural issues by implementing an effective strategy of advocacy, education, and litigation that includes representing clients before the Supreme Court of the United States and international tribunals around the globe. On Tuesday of this week a pivotal decision by Michigan Court of Claims Judge James Redford was announced. He ruled against efforts to remove former President Donald Trump from the state's primary ballot. This comes as the second setback in a week for the rediculous attempts of the Left to use the 14th Amendment to disqualify Trump. Redford asserted that the determination should rest with Congress, and not a single judicial officer. He emphasized that a single judge cannot embody the diverse perspectives of the nation. A liberal group involved in 14th Amendment cases in multiple states, expressed disappointment and promptly announced plans to appeal the ruling to the Michigan Court of Appeals. Simultaneously, they urged the Michigan Supreme Court to expedite the case. The liberal group conveyed their displeasure with the trial court's decision, emphasizing the urgency of their appeal. Meanwhile, Trump campaign spokesman Steven Cheung dismissed the weak and dangerous legal challenges as "un-Constitutional left-wing fantasies" orchestrated to undermine the democratic process. Left-leaning groups across various states have filed similar lawsuits, portraying Trump as the instigator of the January 6 attack. Trump's campaign, however, remains resilient, pointing out previous legal victories and characterizing the cases as attempts by Biden allies to interfere with the electoral choice of the American people, thereby “compromising our fragile democracy.” The 14th Amendment's insurrection clause, rarely invoked since the aftermath of the Civil War, is now at the center of multiple legal battles. With the Michigan decision, attention shifts to the potential appeal and precisely the pending case in Colorado, where a judge is expected to rule by Friday. The Michigan case ruling will likely affect the Colorado judge's decision. Undoubtedly, the case is ultimately headed for the U.S. Supreme Court. A ruling there is of particular significance given the Court's never-before-made rulings on the insurrection clause. Last week, the Minnesota Supreme Court paved the way for Trump to stay on the state's primary ballot, leaving the potential for future legal challenges in the general election. To the left, all is fair. If they can’t figure out how to beat us fair and square, then they simply try to cheat by taking our candidates off the ballot. Michigan Lawsuit Summary and Colorado Update By Jordan Sekulow ELECTION LAW November 15, 2023 For the second time in just the last few days, a state judge has thrown out a lawsuit attempting to ban President Trump from the ballot. This time a Michigan court agreed with the ACLJ’s amicus brief filed on behalf of our client, the Michigan Republican Party, along with six additional state Republican Parties who joined the brief. As we previously explained: [I]n Michigan . . . , we filed a major amicus brief representing the Republican Parties of seven states. A lawsuit there, spearheaded by the same organization that led the lawsuit in Minnesota where we helped secure a victory . . . , seeks to likewise disqualify President Trump from the ballot in that crucial battleground state. Four individuals filed a lawsuit in the Michigan Court of Claims (a subset of the Michigan Court of Appeals), trying to disqualify President Trump from the upcoming Michigan primary elections. We have acted on behalf of the Michigan Republican Party to seek to vindicate that party’s rights by filing an amicus brief. Although our primary client for this amicus brief was the Michigan Republican Party, trying to vindicate its own specific rights to choose its candidates in Michigan, other state Republican parties joined this brief as well, seeking to likewise vindicate their own abilities to choose political candidates. A loss to the Michigan Republican Party is ultimately a loss to any state Republican Party and to the abilities of that state party to choose its candidates. Removing a candidate from the ballot in one state waters down the votes of citizens in other states who are now less likely to have their preferred candidate selected nationally. Our amicus brief was ultimately filed on behalf of seven Republican Parties: the Michigan Republican Party, the Oklahoma Republican Party, the Colorado Republican Committee, the West Virginia Republican Party, the Kansas Republican Party, the North Dakota Republican Party, and the Delaware Republican Party. The ACLJ represented all of these Republican Parties with an amicus brief that thoroughly demonstrated why the Michigan Court of Claims or the Michigan Secretary of State lacks any jurisdiction to decide presidential constitutional qualifications and why any attempt to do so would be an infringement on the First Amendment rights of the state parties. The judge agreed: Michigan Court of Claims Judge James Redford said in his decision Tuesday that questions about Trump’s role in the January 6, 2021, insurrection – and whether it constitutionally bars him from returning to the White House – should be addressed by elected representatives in Congress. He ruled that the matter was a “political question” that shouldn’t be decided by the judicial branch. . . . A court disqualifying Trump would’ve taken that decision away from “a body made up of elected representatives of the people of every state in the nation, and gives it to but one single judicial officer, a person who no matter how well intentioned, evenhanded, fair and learned, cannot in any manner or form possibly embody the represented qualities of every citizen of the nation,” Redford wrote. We have helped secure victories for our clients and members in Oklahoma, Minnesota, and now Michigan, but the fight continues in Colorado (in which our legal team is conducting closing arguments in court today), West Virginia, and Virginia. This battle is sure to intensify, with appeals likely in the coming days. These cases continue to arise in state after state, and the push from the Left to take this unprecedented step seems unrelenting. Thanksgiving Notes From KSGOP Team Thanksgiving 2023 As we all prepare to celebrate Thanksgiving, I want to take a moment to tell you how much your friendship, love, support, and prayers have meant to me and my family this year. We couldn't do it without you. This was indeed a year where, once again, I met many new friends, furthered my relationships with so many folks I already knew, sadly lost a few friends, and had to endure a few friends passing on who I’ll never forget. They will be missed deeply by me - Godspeed until we meet again. I've run for and won the Chairmanship of the Kansas Republican Party and traveled thousands of miles all over Kansas this year. Life and travel continue to be a great learning experience. Oh, the beautiful places I’ve been and the amazing people I’ve met on the fruited plains. Those connections and friendships will last the rest of my days. It was also a year where, once again, a large group of men and women gave up part or all of their lives to defend our freedom across the globe. The biggest thank you to those men and women - past, current, and future. You make us all so proud to be American. It was a year where we, as Americans, witnessed some of our greatest moments as the lone superpower on Earth and as the big brother to every other nation on this miraculous 3rd rock from the sun. We saw Israel attacked by barbarians and the steely resolve of the Western world tested. As a result, America for the first time ever has two aircraft carrier strike groups in the Mediterranean Sea along with at least one Ohio Class submarine. World War 3 is the push of a button away while our decrepit President dodders about like a lost Roomba vacuum while meeting Xi Jinping, the general secretary of the Chinese Communist Party in San Francisco. Our President is an incompetent fool and projects weakness with his every word and action. Putting a Republican back in the White House simply can't come soon enough, for America and the world. As crazy as the world and America are at times, it is unlike any other country that has ever existed. And we get to live in it at a time and place when it is the very best of the best of times, regardless of uncertainties. America has the power to do as we wish, the restraint to stand still and silent, and the clarity to know which is the right tact and precisely when to exercise it. It was also a year where I grew up - again. I found out a little more - again - about the rewards of hard work with a great plan and precise execution in faith, love, family, politics, and business. I learned more about what is real, what is not, and how to know the difference. Too, I turned 55 this year and I’ve learned a bit more about love and priorities – lessons I may never get entirely correct, but I'm trying. Each day is a test and on some days I fail miserably but it doesn’t stop me from getting up the next morning and trying to be better. My wife, Kristi, who is my biggest fan, best friend, and the love of my life, endures these ups and downs with a smile on her face and positive words to prop me up when I need it. She is my anchor in life and I love her more than anything. As we move into and through the holiday season this year, please know you have been a significant part of my life and I pray to God for you, your families, and our country that we may all be filled with joy and love every day and your business or your employer are prosperous and successful at levels unimagined. We all enter each other’s life for a reason. Sometimes it’s obvious, and then sometimes it's not so clear, but knowing there is a reason anyway should make us all more patient and tolerant of our differences and shortcomings – and thankful for the chance to understand and help each other as we all learn and change. I am happy to be on this ride through life with you and look forward to successes and challenges the next year will bring. But I am taking this Thanksgiving Day not to look ahead, but to look back - back on all of my blessings, all of my joys, all of my friends, and the beautiful successes God has graced upon me. As the KSGOP moves closer to our late-January State Convention where elections for Kansas National Committeeman (NCM) and National Comittewoman (NCW) will occur, folks are curious about the NCW and NCM positions and what all of this means. This article is intended to provide some information and clarity, however it is not intended to be definitive but rather educational. Here is an explanantion, each piece borrowed from different sources or experience including RNC sources, current NCW and NCM, and searches of the internet regarding how the governing body of the Republican National Committee, often referred to as “The 168”, is comprised and how it functions: The RNC's membership is made up of 168 members from 56 states and territories (one chair, one national committeeman and one national committeewoman, so 3x56 = 168). The NCW and NCM members are elected by each state and territory to serve a four year term and in that capacity they serve as the governing body of the RNC with each state party chairman. There are typically 3 major meetings a year and other meeting opportunities scattered throughout the year. The RNC does not typically pay for travel expenses and accommodations for any meetings and the Members (at least in Kansas) pay all of their own expenses. NCW and NCM Duties National Level The RNC Committee Members’ primary responsibility is to elect the Chairman and Co-Chairman of the Republican National Committee. They also play an important role as to the formulation of national policies through The Rules of the Republican Party, the Republican Party Platform and Member-driven resolutions. Committee Members also provide key guidance on the interpretation of RNC National policies and to provide input on their revision which occurs every four years at the Republican National Convention. RNC Committee Members should attend all meetings at the state and national levels. State and Local Level On a state and local level, National Committee Members serve as leaders of the Party and fulfil several different roles including: advisor, implementer, fundraiser, moderator, cheerleader, counselor, activist, and motivator. RNC Members can, from time to time, act as spokespersons for the National Committee and respective state party committees. Other responsibilities Attend all RNC meetings Deliver RNC messages to the state and/or local committee(s) Facilitate party utilization of RNC information and resources Meet often with local and state party leaders Communicate with the RNC Regional Political Director Work to ensure party unity as an effective moderator, should internal disputes arise Work to implement RNC National programs in Kansas Work with state party leaders to develop and coordinate party programs Be willing to travel and give speeches Maintain a presence and involvement in state and local activities Work with state party leaders as a productive member of the State Executive Committee Serve as a surrogate when needed to campaign for state and local candidates Support the work of the party with personal financial contributions Engage grassroots activists and actively recruit new party workers RNC Meetings RNC Committee Members attend three annual meetings: The January Winter Meeting, the Spring Meeting in April or May and the Summer Meeting in July or August. When RNC Committee Members meet, they vote on proposals that maintain essential business of the party such as review of the annual RNC budget, review of Member-submitted resolutions and review & interpretation of Party Rules, among other things. RNC Committee Members are responsible for making travel and lodging arrangements and personally providing all funds required for travel and attendance at RNC meetings. Terms of Office An RNC Committee Member is elected to a four-year term which commences at the adjournment of the Republican National Convention immediately following their election and lasts until the adjournment of the following quadrennial National Convention. Facts and Figures Biden Has Left America's Veterans Behind Service members, veterans, and Gold Star families deserve a better commander-in-chief than Joe Biden. What you need to know: Under Biden’s leadership, service members, veterans, and Gold Star families have been treated disgracefully. Because of Biden’s botched Afghanistan withdrawal, 13 brave U.S. service members lost their lives – deaths that Biden claimed were inevitable. During the dignified transfer of these 13 service members, Biden repeatedly checked his watch in a blatant show of disrespect. In Biden’s first year as president, he completely ignored the anniversary of D-Day, and the following year waited until 8:45pm to acknowledge the bravery and sacrifice of America’s heroes. Recently, Biden abruptly walked out of a Medal of Honor ceremony, even before the closing benediction. In October, Biden doxxed U.S. special forces soldiers in Israel by sharing a photo on Instagram that showed the faces of service members on assignment. His administration provided unauthorized access to the military records of seven Republican congressional candidates in 2022. As vice president, Biden called American service members who didn’t clap for him “stupid bastards.” The U.S. military is currently facing unprecedented recruiting difficulties under Biden. The Army, Navy, and Air Force are all on track to miss their enlistment goals this year, with the Army now suffering the worst shortfall in five decades. Amid this shortfall, Biden is more committed to promoting his woke agenda than ensuring success on the battlefield. On Biden’s watch, the Defense Department is injecting critical race theory into its education programs. The Air Force Academy admits that “tenets of critical race theory” are taught in its classrooms and has curriculum which tells cadets to use gender inclusive terms and to avoid words like “mom and dad.” The Navy included far-left radical Ibram X. Kendi’s anti-American book “How to Be An Antiracist” on its 2021 reading list. Biden pushed a vaccine mandate on our military, firing service members with religious objections to further his political agenda. The bottom line: America’s veterans put their lives on the line to defend our country and protect our freedoms, and they deserve better leadership and accountability than Joe Biden. Third GOP Debate At the Third Republican Primary Debate in Miami, Florida, voters were presented with a clear choice of winning Republican policies vs. the failed Biden-Harris agenda. What you need to know: Republican leadership in the White House will get our country back on track. Our Republican nominee will be the next President of the United States, and this debate showcased many of our great Republican candidates and their ideas for the future of our country. For 3 years, Joe Biden and the Democrats have delivered crisis after crisis. Voters are ready for change. Republican candidates on the debate stage highlighted their plan to restore America’s standing in the world and support our allies including Israel, secure our border and protect our communities, and jumpstart our economy. Now more than ever, the Republican Party must stand with our ally Israel and denounce anti-Semitism in our own country and around the world. The decision for the RNC to partner with the RJC for this debate reaffirms the importance of foreign policy – particularly our nation’s commitment to Israel - on the debate stage. Republicans Polling repeatedly shows Republican candidates and their policies are what Americans are looking for. 76% of the country thinks the nation is on the wrong track. The Real Clear Politics average of polling on Joe Biden’s foreign policy record is underwater at 57% disapproval. A recent CNN poll showed only 36% view Joe Biden as an “effective global leader.” In a Fox News poll 71% of registered voters surveyed said the current levels of security at the border under Joe Biden are not strict enough.
