John, BREAKING: Free Speech For People has just filed an appeal in LaBrant v. Benson, our lawsuit on behalf of a diverse group of Michigan voters challenging Donald Trump’s candidacy. In addition to filing with the Michigan Court of Appeals, we have filed in the Michigan Supreme Court an emergency bypass application seeking immediate Supreme Court review, citing the urgency of expedited resolution due to the pressing need to finalize and print the ballots. The Michigan Court of Claims recently ruled against our complaint urging Secretary of State Jocelyn Benson to bar Trump from the ballot under the Insurrectionist Disqualification Clause, opining that the federal “political question doctrine” bars judicial consideration “at the present time.” The fact of the matter, as we have outlined in our appeal, is that states can legitimately exclude constitutionally ineligible candidates from presidential ballots. The federal “political question doctrine” cited by the Court of Claims only applies when it asks a court to decide a question that the Constitution specifically assigns to another branch of government. Put simply, every state in the Union has the power (and the obligation) to enforce the Insurrectionist Disqualification Clause. This decision by the Court of Claims will not deter us. We will continue to fight to uphold our Constitution and urge Secretaries of State and election officials nationwide to bar Trump from public office under the Insurrectionist Disqualification Clause.
