For generations, with reprehensible exceptions, the United States has rejected the torture of prisoners. One of these exceptions unfortunately continues in full operation to this day: that is the practice of solitary confinement.
Solitary confinement destroys the human spirit. It does nothing to reconnect prisoners to humanity and it worsens the alienation, isolation, and ill will toward society that drives the worst of antisocial criminal behaviors.
The United Nations has condemned solitary confinement as a form of psychological torture, which is exactly what it is. Human beings are social creatures, we need connection with other human beings just like we need food, air, and water.
Today, over 122,000 people are locked in solitary confinement for months or years in American prisons, many of which are privately owned. Immigration detention facilities also include solitary confinement cells. People of color, young, LGBTQ+, and those with low incomes are disproportionately subjected to this inhumane treatment.

The End Solitary Confinement Act includes several major features. Most importantly, it would end solitary confinement in federal prisons, jails, and immigrant detention centers. The legislation would permit up to four hours of isolation for emergency de-escalation, but this would not be used as punishment.
It would also require that all federal prisoners have at least 14 hours per day of meaningful out-of-cell time, including group programming and receiving basic services.
The bill provides mechanisms for oversight and enforcement, including a community monitoring body to investigate complaints and to review regular reports on the use of solitary confinement when it is used, and self-harm incidents.
There are due process provisions, ensuring prisoners have access to legal representation and neutral parties as well as additional protections for vulnerable populations.
Finally, the bill creates incentives for state and local governments to also end the use of solitary confinement.
Solitary confinement is a cruel and inhumane punishment that should already be banned under the Eighth Amendment to the U.S. Constitution. Sign on now as a grass roots co-sponsor of the End Solitary Confinement Act.
