A case currently before the Supreme Court could hand a $350 billion tax giveaway to corporations like Apple, Microsoft, Google, and Goldman Sachs.

But it’s not just these corporations that stand to benefit.

We've just learned that Supreme Court Justices John Roberts and Samuel Alito personally own stock in 19 of the companies that would benefit from a favorable ruling — and despite this glaring conflict of interest, they have so far refused to recuse themselves from the case.1

The Supreme Court is already facing a massive public backlash for a growing list of corruption scandals, which creates a real opportunity to force Roberts and Alito to recuse. And if they don’t, that will fuel demands for Congress to take action to enact a mandatory code of ethics for the Supreme Court.

Moore v. U.S. has the potential to upend our current tax code by significantly restricting Congress’ authority to tax income.2

The details of the case involve a technical provision of the 2017 Tax Cuts and Jobs Act dealing with profits earned overseas by U.S. corporations, but the implications could be vast, starting with a one-time $350 billion tax windfall to the nation’s wealthiest corporations and individuals.

In addition, the case could result in all wealth taxes being declared unconstitutional, including Senator Elizabeth Warren’s ultra-millionaire tax, which would raise nearly $4 trillion to rebuild America’s middle class through a small tax on massive fortunes over $50 million.3

If these justices followed basic judicial ethics, they would recuse themselves in cases where they stand to benefit financially. But these justices have proven they won’t step aside unless they’re forced to.
