Process change for mediation requests
New process begins November 1
In July, OAH announced changes to the way that Workers' Compensation parties request a mediation. Now, we are further streamlining the process.
What's changing?
Currently, parties select two preferred mediators when requesting a mediation.
Beginning *November 1,* parties must rank their preferred mediators in order of preference. Parties must indicate at least two preferred mediators, but may rank all mediators if they wish.
If the parties' selected dates are not available for any of the preferred mediators, OAH's schedulers will schedule the first available date for all parties, including one of the parties' preferred mediators.
The new process
Beginning *November 1, 2023*, to request a mediation:
* *eFile a mediation request form [ [link removed] ] *in C-Track. You *must* specify:
* *Specific dates* that work for all parties, approximately 45-90 days in the future
* The parties' preferred mediators, *ranked in order of preference.*
* If the parties' selected dates are not available for any of the preferred mediators, OAH's schedulers will schedule the first available date for all parties, including one of the preferred mediators.
* OAH will issue a Notice of Mediation containing the scheduling information.
Why?
This change will streamline the process to save everyone time and significantly reduce the amount of time court staff spend coordinating parties' schedules.
Form
