Mesack: CFPB is evading its legal requirements ([link removed] )

NAFCU Senior Vice President of Government Affairs Greg Mesack, in a new op-ed for CU Insight, called attention to the CFPB’s recent advisory opinion claiming large financial institutions cannot charge certain legal fees. In the piece, Mesack remarked that the bureau “side-stepped the Administrative Procedure Act (APA), avoided stakeholder input, and forced down a major policy change painted as mere ‘guidance.’”

Lawmakers are continuing to work on government funding bills this week, as current funding is set to expire Nov. 17. The Senate is set to vote on potential amendments to its minibus, and newly-elected House Speaker Mike Johnson, R-La., plans for the chamber to bring three appropriations bills to the floor this week.

NAFCU, trades ask for 90-day comment period on 1033 rulemaking ([link removed] )

NAFCU and other financial trade associations Friday wrote to the CFPB requesting the comment period for the notice of proposed rulemaking (NPRM) on section 1033 of the Dodd-Frank Act related to personal financial data rights move from 60 days to 90 days after its publication in the Federal Register. Of note, the selected comment period and deadline is a time typically unavailable for those who observe various holidays in November and December.
