The legal fight for the preservation of women’s spaces moves forward in Tenth Circuit

In the ongoing battle to preserve women’s sports and spaces, I want to give you an important update. After a federal court in Wyoming dismissed Westenbroek v. Kappa Kappa Gamma, the Tenth Circuit Court of Appeals has scheduled briefing in this monumental case maintaining that “woman” in a sorority’s bylaws means “woman.” Â
The sorority involved in the lawsuit, Kappa Kappa Gamma, attempted to avoid appellate review entirely. In response, the female plaintiffs, represented by Independent Women’s Law Center, argued appellate review is necessary. In very exciting news, the Tenth Circuit decided to continue with the appeal, with our first brief due in December.
Where the district court failed women, the Tenth Circuit has reinstated hope and a chance to save sisterhood. By moving forward with briefing, we will get to stand up for women before the courts.Â
