Hi John,

It’s official! Yesterday evening was a major win for affordable housing solutions as Governor Gavin Newsom signed all of the NPH-sponsored bills on his desk into law! This is great news for all of us at NPH, our members, and of course our Bay Area communities and neighbors. As CalMatters reported, “California is now on the verge of laying down a welcome mat for most major affordable housing projects across the state.”

 
 

Our Approach NPH’s goal this year was to dig deep to remove barriers and unlock opportunity that will meaningfully change the landscape of affordable housing at large. We did not resign ourselves to small adjustments and pilot programs; we set out to break down large obstacles that have been in our path, now allowing us to build from our proven, vetted solutions. From making it easier to build affordable housing to addressing outdated state rules that limit local communities’ ability to invest in affordable housing and more, we set out with big ambitions, scaled to our communities’ urgency.

Highlights From 2023’s Legislative Wins:

🗳️ Making it Easier to Pass Local Affordable Housing Bonds

  • ACA 1 (Aguiar-Curry) - Lowers the voter threshold from 2/3 to 55% for affordable housing bond measures, giving local communities the tools they need to invest in affordable housing. This initiative will undergo clean-up language in the 2024 legislative process before heading to voters’ ballots for final approval.

🏗️ Making It Easier to Create More Affordable Homes

  • SB 4 (Wiener) - Opens over 171,000 potentially developable acres statewide owned by faith institutions or nonprofit colleges, which is nearly five times the size of the city of Oakland, for streamlined affordable housing projects.
     
  • SB 423 (Wiener) - Extends the streamlining provisions of Senator Weiner's SB 35 and allows fast-track development of affordable housing and reasonable labor standards for new housing development.

💪 Strengthening Our Regional Approach

  • AB 1319 (Wicks) - Maximizes benefits that Bay Area Housing Finance Authority (BAHFA) can deliver for the needs of Bay Area residents facing rising housing costs, housing instability, and homelessness.

🌆 Ensuring Public Lands Serve the Public Good

  • AB 480 (Ting) - Updates the Surplus Land Act, bringing clarity and adding consequences for violations.

👪 Protecting Low-Income Homeowners

  • AB 572 (Haney) - Caps some HOA fee increases for Below Market Rate units developed in 2025 and onwards at either 5% plus inflation or a flat 10%, whichever is less.
 

🏆 Our successes this year have helped lay the groundwork for an even bigger strategy in 2024, taking bold steps for system change and winning major resources for affordable housing in the Bay Area. Join us!
