The Supreme Court is back in session and preparing to hear a case that could threaten our ability to fairly tax corporations and the ultra-wealthy—both now and in the future. At first glance, Moore v. U.S. is about a seemingly arcane legal debate related to a one-time “transition” tax on offshore corporate profits. But conservatives—from the Wall Street Journal editorial board to the most prominent right wing think tanks in the country—hope to use the case as a way to block Congress from fairly taxing sophisticated investors and big corporations when they use accounting and investment tricks to disguise their real income.[1]
More than a dozen existing tax laws are at stake—with trillions of dollars of revenue on the line—as is our ability to tax billionaires and centimillionaires in the future on their largest source of income: growth in their investments, whether they sell assets or simply borrow against them.
If the Supreme Court does the billionaires’ bidding, it could preemptively declare a tax on billionaire investment gains, such as the Billionaire Income Tax, unconstitutional. This is incredibly dangerous to our movement to make multimillionaires and billionaires pay their fair share.
But the Court shouldn’t even consider the case. That’s because the Moores and their attorneys lied in their court filings about key facts central to the case.

In reality, the Moores are not modest would-be philanthropists as they claim, but sophisticated financiers who deliberately engineered this situation with a clear profit motive―and they hid the facts that didn’t help their case.
The Supreme Court chose to hear this case—with the support of at least four justices—before the facts were known. But now that they know the case is built on lies and factual inaccuracies, the Supreme Court must immediately dismiss the case and restore the lower court’s decision upholding the constitutionality of these taxes, in accordance with long-standing precedent.
The Court is being rocked by scandal after scandal highlighting how the justices have abused their positions of public trust for their own personal gain. But they won’t take action unless they feel forced to do so by public pressure.
We’ve been building massive support for proposals to tax the wealth gains of millionaires and billionaires, ensuring the ultra-wealthy are paying federal income taxes each year, just like working people do. But if the Supreme Court sides with the wealthy, it could have a devastating impact on our ability to tax the rich and invest those tax dollars in services for working families.
