Senate Democrats need to act now to restore legitimacy to the court Indivisibles,
Over the past few years, Republicans have stacked our courts with right-wing ideologues handpicked by extremely conservative dark money groups. Now, we're living through the fallout. We've watched as the Supreme Court overturned Roe, banned affirmative action, made it harder to regulate polluters, and allowed businesses to openly discriminate against LGBTQ+ people. With a new court term underway, we don't expect much to be different.
What makes this all the more enraging is the MAGA justices' blatantly corrupt behavior. It wasn't enough for them to roll back our fundamental rights and give corporations free rein over our economy -- they also got rewarded for it by MAGA donors with luxury vacations, rides on private jets and yachts, and gifts that amounted to hundreds of thousands of dollars from right-wing interest groups and billionaires with business before the court.
It’s no wonder the Supreme Court is facing a legitimacy crisis. Its approval rating is below 37%, and over 70% of the public thinks the court is too influenced by partisan politics. The first step to restoring legitimacy to the court is uncovering the full extent of the MAGA justices' corrupt behavior -- and that work can start right now.
So far, thousands of Indivisibles have signed our letter calling on Leader Schumer and Judiciary Committee Chairman Durbin to hold investigatory hearings and subpoena Justice Thomas, Justice Alito, and their billionaire benefactors.
Indivisibles in blue states across the country are demanding Senate Democrats use their oversight authority to rein in a court that's out of control. With a new term underway, we can't let up now. It's important to remember Democratic senators are not powerless. Despite what Samuel Alito might claim in his Wall Street Journal op-eds, Congress has the authority -- and the responsibility -- to regulate the Supreme Court. And we don't have to wait for a trifecta to get this work started. Sen. Durbin and Democrats on other relevant committees can begin holding hearings and issuing subpoenas right now.
We're also calling on Sen. Schumer to hold a vote on the Supreme Court Ethics, Recusal, and Transparency Act (SCERT). Every other federal judge is bound by a code of ethics, and it's time for Congress to impose one on the Supreme Court too. While SCERT has no chance of passing through the MAGA-controlled House, we can build momentum now to get it passed soon -- and we can get Republicans on the record opposing something as basic as a code of ethics.
There are still some Democratic senators who are hesitant to use their full authority to investigate the MAGA justices. Some are worried about politicizing the court, even though it’s already been politicized by Republicans and the right-wing interest groups who helped them stack the bench. Others are worried about the unprecedented nature of hauling a justice before the Judiciary Committee, even though we’re seeing unprecedented levels of corrupt behavior. But if we do nothing, nothing will change. And nobody -- not even a Supreme Court justice -- is above accountability.
We have to apply consistent grassroots pressure to make sure our Members of Congress do everything in their power to hold the MAGA justices accountable.
