Affordable and Supportive Housing Sales and Use Tax (Chapter 365-240 WAC)

The Washington State Department of Commerce is initiating rulemaking for Chapter 365-240 WAC to align with SB 5604 (Laws of 2023), which amended the allowable uses of the Affordable and Supportive Housing Sales and Use Tax.

The subject of rulemaking includes:

  • Amending chapter 365-240 WAC to align with the changes made to RCW 82.14.540 by removing the jurisdiction population size requirement for using the tax revenue for rental assistance, and updating to indicate that all cities and counties may use tax revenue for administrative costs, not to exceed 10%.
  • Updating reporting requirements to include reporting on use of funds for administrative costs.
