The special counsel overseeing an extensive investigation into President Joe Biden's handling of classified documents during his long tenure in office is considering the possibility of requesting the president's testimony.
Robert K. Hur has been diligently working behind the scenes for months, examining the procedures for storing documents during President Biden's time in the U.S. Senate and beyond. His approach has been deliberately low-profile, aimed at avoiding the political controversies that surrounded similar cases involving former President Donald Trump and Justice Department special counsel Jack Smith.
Having navigated the political landscape of Washington for years, Hur is well aware of the political nature of such investigations. He was appointed by President Trump in 2017 to lead the Maryland U.S. Attorney's Office and has previous experience working under Deputy Attorney General Rod Rosenstein, who appointed Robert Mueller as special counsel to investigate potential ties between Trump's 2016 campaign and Russian operatives.
Currently, Hur and his team are weighing the possibility of requesting an interview with President Biden and the likelihood of his cooperation. While a face-to-face meeting between Biden and Hur is unlikely, the president has multiple options for cooperating with the investigation, including providing written testimony or responding to questions through administration attorneys.
The investigation has already interviewed high-ranking officials in the federal government, including Secretary of State Anthony Blinken, who managed Biden's documents after his vice presidency; Ron Klain, former White House chief of staff; and Michael R. Carpenter, former managing director of the Penn Biden Center, according to reports from the New York Times.
In November 2022, President Biden's aides informed the National Archives that top-secret documents had been discovered in the garage of his Delaware home. This revelation brought attention to Biden's handling of classified materials at a time when President Trump faced calls from the Justice Department to return allegedly classified documents. The FBI subsequently conducted a search of President Biden's residence, initiating the ongoing federal investigation into the commander-in-chief.
The White House has sought to downplay the significance of the investigation, asserting that the president is cooperating. This is in contrast to President Trump, who did not return records and claimed that anything in his possession was declassified under the Presidential Records Act. He has criticized the perceived lack of focus on Biden's documents case, characterizing it as indicative of a two-tiered justice system allegedly weaponized by the Biden administration against his leading challenger in the upcoming election.
