STEFANIK v. HOCHUL – Elise is Leading a MASSIVE Lawsuit to Stop Unconstitutional Unregulated Mass Mail Ballot Law in NY
Elise is leading a coalition of Republicans and Conservatives to protect what is left of New York’s election integrity – and will not allow Kathy Hochul and the NY Democrats to trample on the State constitution. That is why she has filed a lawsuit against Kathy Hochul joined by National and State Republicans.
– WHAT: Elise just filed a lawsuit against Gov. Kathy Hochul for signing legislation that allows unregulated mass mail ballots, in CLEAR violation of the New York state constitution. This UNCONSTITUTIONAL legislation from Gov. Kathy Hochul and New York Democrats allows unregulated mass mail ballots.
The New York state constitution CLEARLY reserves absentee voting for voters who are physically absent from their county of residence OR sick. No-excuse unregulated mail ballot voting is not constitutionally allowed.
The only way to LEGALLY change this voting practice is by passing a constitutional amendment.
New York Democrats already tried to get this done the legal way (via constitutional referendum), and FAILED. In 2021, it was voted down by New Yorkers (55% against unregulated mass mail ballots, while 45% voted in favor).
– WHY IT MATTERS: By ignoring the outcome of the failed referendum and trying to pass this law, Kathy Hochul and New York Democrats are ignoring the democratic process – undermining the state constitution and the rule of law.

Meet Nicole: Nicole Malliotakis is the daughter of Cuban and Greek immigrants. Prior to serving in Congress, Nicole was a prominent New York State Assemblywoman. Nicole Malliotakis was elected to the United States House of Representatives in November 2020, defeating an incumbent Democrat by more than 18,000 votes. She currently serves as Assistant Whip for the House Republican Conference and on the House Transportation and Infrastructure and Foreign Affairs committees.
