If you simply googled the word “lawsuit” in the past week, you probably saw result after result about CREW’s lawsuit challenging Trump’s constitutional eligibility to be on the 2024 presidential ballot in Colorado.

Spoiler alert: we already have one legal win under our belt:

When Trump’s lawyers quickly tried to remove CREW’s lawsuit to federal court, we responded that their attempt to move the case was invalid—then just this Tuesday, Trump’s lawyers had to concede [[link removed]] and the federal judge sent the case back to state court. That’s a defeat for Trump, and a win for CREW that brings us a step closer to proving our case in court.

Now, let’s get into some of those search results:

CREW President Noah Bookbinder and Executive Vice President Donald Sherman’s op-ed for MSNBC on our Colorado lawsuit [[link removed]] last weekend explained why the lawsuit can succeed, including strong precedent and amazing plaintiffs. Meanwhile, CREW Senior Counsel Nik Sus and experienced trial lawyers who are also on the case wrote an op-ed in Newsweek [[link removed]] with a rundown of how Section 3 of the 14th Amendment operates independently from criminal convictions, and how it’s been used to remove insurrectionists from office before.

Last week, two election law experts we’re partnering with in Colorado, Martha Tierney and Mario Nicolais, wrote an op-ed in the Denver Post [[link removed].] describing how—by the will of Colorado voters themselves—accountability for Trump under 14th Amendment will and must start in their state with Secretary of State Jena Griswold enforcing Section 3.

Noah and Donald were also on national television several times in the days after we filed. MSNBC host Ali Velshi invited Noah on to discuss the lawsuit [[link removed]] and how in Colorado, voters have the right to go to court and challenge a candidate’s eligibility. Donald spoke to MSNBC’s Katie Phang [[link removed]] about existing precedent (set by CREW in New Mexico) and what it will take to win our case. Noah also appeared on CNN Newsroom With Jim Acosta and was featured on NPR’s On Point podcast, while CNN’s Michael Smerconish shouted out CREW’s lawsuit [[link removed]] and MSNBC did another segment on how CREW’s efforts to bar Trump with 14th Amendment are gaining steam [[link removed]] . The Colorado Switchblade podcast [[link removed]] also invited Donald on to discuss why we’re beginning our fight in its state.

As we’re appearing on national news around the clock, we’re receiving a lot of questions: What does “engaging in an insurrection” exactly mean? Has Section 3 been used in the past? We also partnered with the Project On Government Oversight ahead of filing our lawsuit to publish a comprehensive report showing that every state has kept ineligible candidates off the ballot, and Trump could—and should—be next [[link removed]] . Barring or removing candidates from the ballot for failing to meet basic qualifications is a routine process, and Trump can be barred through the same mechanisms.
