Yesterday, Judge Hanen in Texas made a ruling on the "Final Rule" for DACA, which was the Biden Administration's attempt to "fortify" the DACA program. Judge Hanen ruled that the Final Rule, like the original DACA memorandum, is illegal.
At this time, there are no changes to the DACA program due to this court order. DACA recipients can still renew their DACA and apply for Advance Parole, and new applications are still not being processed. Legal experts expect this case to be taken back to the 5th Circuit and eventually to the Supreme Court, but today there are no changes to the program due to this ruling.
If you are a current DACA recipient, you are always welcome to contact us with your specific legal questions.
Why does this keep happening? Because Congress has completely shirked their responsibility to create the needed permanent changes through legislation. Until Congress acts, DACA remains in danger and subject to disruptions caused by litigation.
What can we do?
We wanted to share with you all some resources from Home Is Here, a campaign by United We Dream. Right now, there are a handful of things that DACA recipients and allies can do to stay engaged with this issue.
