The Biden Administration and the Bureau of Alcohol, Tobacco, Firearms and Explosives just proposed a new rule to make thousands of gun purchases newly subject to background checks.

Thousands of gun dealers currently do not conduct background checks, allowing loads of criminals to get guns.

In 2022, the Bipartisan Safer Communities Act clarified the definition of a federally licensed firearms dealer, to make it clearer which gun dealers needed to be running background checks. This prompted the ATF’s new rule.

Here’s why this is a BIG deal. Only people "engaged in the business" of selling firearms have to conduct background checks on buyers. In the era of gun shows and online firearm marketplaces, the pre-internet definition had become outdated. Thousands of part time sellers are making big profits and selling multiple guns a year — all without running a background check.

Our bill changed the definition of "engaged in the business" to clarify that selling guns didn't need to be your "livelihood." You just have to be selling guns in order to make a profit.

The proposed rule would implement this change, making it crystal clear that people are "engaged in the business" if they are doing things like advertising guns online or renting space at a gun show.

If you're selling guns to make money, this will make it clear you've got to do a quick background check on the buyer. This could dramatically erode the flow of guns to criminals.
