It’s not every day that we see two U.S. senators from opposite sides of the political spectrum say what we’ve all been thinking about Big Tech.
As Senators Elizabeth Warren and Lindsey Graham wrote in the New York Times:
“Enough is enough. It’s time to rein in Big Tech. And we can’t do it with a law that only nibbles around the edges of the problem… Congress is too slow, it lacks the tech expertise… Meaningful change — the change worth engaging every member of Congress to fight for — is structural.” [1]

The Digital Consumer Protection Commission Act would establish a new regulatory agency tasked with overseeing major tech giants such as Facebook, Google, and Amazon. This regulator's four core objectives would be:

Transparency: Mandate transparent terms of service and content moderation policies for dominant platforms while granting consumers the right to appeal violations, including failure to remove harmful content like child sexual abuse materials (CSAM).

Competition: Prohibit abuses of dominance, including self-preferencing, tying arrangements, predispute arbitration agreements, class-action waivers, noncompete agreements, and no-poach agreements by Big Tech firms. This would prohibit conflicts of interest like Amazon owning its marketplace and competing on that platform.

Privacy: Guarantee users the right to access their personal data and to know when their personal data is collected and processed.

National Security: Mandate dominant platforms be either owned by U.S. citizens or have a U.S. subsidiary, while also imposing restrictions on data processing in certain countries and mandating the identification of bots on the platforms.
